I have an Etsy shop (which is in serious need of updating!). I have several cards for sale that I made using various digital and rubber stamps and images.
I received an email with a cease and desist order for one of my cards!! It seems that you are not allowed to use the phrase "Save the Ta Tas" without express written permission from a specific "Ta Tas" company!! Ummm... ok... but the phrase I used was a part of a digi image that I PURCHASED from a digi stamp site.
Yep!! All I can think is that they must search Etsy, etc. for people using the phrase... they seem to have dibs on it. I wonder if I could copyrite my phrase "holy crackers"? ;)
Oh, and the really stupid thing? It's not even like the card itself was going to be making me big bucks or anything, it was a $2 card. It's the principle.
Trying to do a little research on it for you. I have found that there is a trademark registered for the Save the Tatas in black lettering with a pink ribbon over it as a an image. That is registered to the "Tatas" site. I do not know if they can however copyright the "save the tatas" phrase (not related to a graphic image). It may be public domain, I do not know for sure, need to do more research. There is a lot of things using "save the ta ta's" which has a space, and also some that does not have a space in "tatas". Don't know if that makes a difference or not.
Also, I looked in Etsy but couldn't find your shop, do you have a link? Just wanted to see what the items in questions were.
Thanks Sonya! I took down the card. I can email you a pic if you'd like to see it. There's no pink ribbon on the phrase on my card... I'm thinking I got it from McMahon Five, but I would have to look in my files to make sure...

I would think that if they have a "case" it would be against the creator of the digi stamp, not the person who bought the digi stamp.

That's what I was thinking.
If I had an Etsy shop and used an image from a company I thought was ok, I would contact the company producing the image. They need to be made aware.
Don't know how intrinsic to the design the original wording was - however if it is salvageable I would go for it.
Reminds me when Komen tried to get all bully about using "Race for the" by any organization.
Ta Tas in Australia is what todlers do when the grandparents leave. Ha Ha.
I am at a loss as to how some company is able to trademark the use of a word that is in common language usage unless it is presented in some special way (like the graphic) mentioned. I seem to remember something to do with a camera company and the term photographic labs or similar, and then there was Ugg Boot - a generic in Australia.
As for searching shops for the words, I expect they have some sort of 'search bot' to do it for them. I wonder if they even look at the use of the item in question before sending out their letter.
Seems to be a lot of this going on at present. Dare I say, even among hobby crafters.

I can't remember how or why I have this piece of useless information in my brain, but I think the word "ta ta's" is somehow derived or is a shortened version of "tassies/tassels", the things female strippers glue to their nipples.
Add that to the list of useless facts you never needed to know LOL!

Ha, and I think of the big Indian car manufacturer, Tata Motors every time I see the word :rolleyes:. It was only on Splitcoast that I learned it was a slang word for breasts. I'm sure I've seen several stamps with that Save the Ta Tas sentiment.
I have seen so many things with "save the ta tas"--not sure if I typed it exactly as printed.
I think it's silly for you to have to remove your card.
About 10 years ago my doctor gave me a little thing to hang in the shower with this saying on it. I think her's was related to the breast cancer foundation. It was a reminder to do your monthly breast exam.
I see lots of stamps that have different sayings on them that I've heard all my life....I can't believe that companies own all of them. Just seems too far fetched to me. But what do I know.
I will be very interested to see what you learn from the digital company that created the stamp.
