Enable Alert for New Tim Holtz/Tonic Stamp Platform
I have been scouting out different places that have the Stamp Platform for pre-order and the best price so far is $31.99 at The Funkie Junkie.com apparently in Gainesville, FL . Has anyone ordered anything from them...is this a legitamate store?
I've preordered from Funkie Junkie Boutique many times and always been satisfied with their price and service. I've been watching this item too and $31.99 seems to be the best price thus far.
I've ordered from funkie junkie. Great service and I'd gladly recommend them
Ok...I put the TH Stamp Platform in my cart and when the shipping was calculated it came to $27.00 US to Canada. Way too rich for my blood!!! I am going to check out Marco's Paper next. Does anyone know if they ship using USPS to Canada?
Well just had an email from the nice folks at Funkie Junkie Boutique about my Platform preorder."If you are receiving this email, you have a Tim Holtz Stamp Platform pre-ordered from The Funkie Junkie Boutique."It follows,
"We have just received word that there will be a 6-8 week delay in the launch of this product due to a legal concern with the product. At this point, we are no longer taking pre-orders for the Stamp Platform. Additionally, we will be refunding your purchase price for this product. However, we will not cancel your pending pre-order unless you request us to. Once we receive the product, if you still want it, we will make arrangements for you to pay for it at that time. Handling it this way will ensure that you do not lose your place in the fulfillment queue once the product is available."
TupeloDesigns sent out a general email with the following message from Tonic Studios. Sounds like MSP's lawyers cast a wide net, which isn't unusual. But just like we have more than one manufacturer of cars, even though they all have four wheels and an engine, Tim's stamping platform is different enough from MSP's that I'm betting on Tonic.
(Where Tonic mentions customers they're talking about retailers/etc. who sell their products.)
A Special Message from Tonic Studios
Tonic is very excited to launch the new Tim Holtz Stamping platform; however, we need to inform you of a delay in the launch of this product. As you may be aware My Sweet Petunia (MSP) have been granted a patent on their MISTI Stamping Platform.
While we do not consider our Tim Holtz Tonic Studios Stamp Platform to be an infringement of this patent and its claims, we do not want to expose our customers to any legal action from MSP in the event that they sell our product. The ongoing protection and sustainability of the Tonic brand and our products are paramount to our ongoing relationship with all our retail partners.
Our attorneys are working on this case and we expect to have a resolution within the next 4 weeks. We apologize for this inconvenience but we fully expect to be able to ship to you within the next 6 - 8 weeks.
We will be giving updates as we work with all parties to resolve this matter and hope to give you more information soon.
We appreciate your understanding and patience in this matter.
I have my fingers crossed that Tonic will get things worked out. I saw one being used in a video and (in my opinion) it looks to be a much higher quality tool.
We have had them over here in the UK, and I can vouch for the fact it's awesome! Really love it, great high quality build, no complaints or issues at all. If anyone is thinking about it, I've done a blog post on the unboxing and first try out!
Here's a link to the filing document. It state's the Misti has made millions. I have a Misti, but I want the Tonic too! Might have to order from the UK
I read that bit too, darlenemcg. I think that may somewhat dent the image of a poor struggling woman trying to protect her investment. I suspect that line may rankle with a lot of crafters, who frequently seem to be treated as a cash-cow with crafting products. Not saying she doesn't have a right to patent her EXACT design, but from what I've seen of MISTI's, and having got my hands on the TH one, I'd say it is far enough different not have any problems with this legal challenge. And I've said before, I can't for one minute imagine that Tim & Tonic were not smart enough to have run things through their own Patent lawyers first, knowing that a Patent application was in the system. Fingers crossed for you guys that this gets ended quickly.
Generally that's specified when it's believed that a jury would be more sympathetic than just a judge - in this case a solo woman-owned business versus the Big Guys.
I didn't give it much thought in the beginning because I have the Misti in two sizes, but all this attention has heightened my interest in acquiring one and caused me to take a closer look at how it might be useful.
I have ordered many supplies and chipboard from the junkie junkie. Never had a problem. Actually got my order pretty quick in California. They are legit. Hope this helps. I pre-ordered mine from Simon says stamp back in January , but because of this lawsuit they got going on, I still have yet to receive it.
